Florida is a Judicial Foreclosure State. This means the mortgage company or Bank is required to get approval from the court before they can proceed with the foreclosure process. The Bank or Mortgage Company has to prove its case against you.
You can defend your foreclosure by yourself, its called “pro se”. An attorney is not required, although preferable.
The first and probably the most important factor you need to address is your Answer to the foreclosure complaint that was filed and served upon you with a Summons by a Process Server. Your Answer is the foundation to your case and prevents a the Plaintiff from quickly moving forward to evict you from your home. In some cases there may be defenses ( called Affirmative Defenses) that may prevent the Court ruling in the Bank’s favor.

There are other options to foreclosure you should be aware of :
Deed in Lieu- This option basically gives the mortgage company your home voluntarily in full without any money paid to you. They become the title holder/owner of the property.
Repayment- This requires you to pay all arrears and all costs IN FULL all at once thus stopping the foreclosure.
Loan Modification - This will add your arrears to the loan balance and increase your monthly payments. This does not eliminate the foreclosure until fully paid.
